In Crime No. 203/2018 registered with Alibaug Police Station for offence punishable under Sections 417, 419, 420, 465, 467, 468,

2 20.82.19 aba.doc 471 r/w 34 of the Indian Penal Code, applicant is seeking pre-arrest bail.

Heard respective counsel. This Court has already granted Adinterim relief in favour of applicants on 11/01/2019. Main accused Prasad Mhatre is already arrested and subsequently released on bail.

There are no allegations against the applicants which prompts either recovery of amount or otherwise.

That being so, in my opinion, custodial interrogation of the applicants is not warranted. Hence, following order: (A) In the event of arrest of the applicant in Crime No. 203/2018 registered with Alibaug Police Station, applicants be released on bail on furnishing P.R. bond in the sum of Rs. 25,000/- each with one or more sureties in the like amount. (B) Applicants shall attend the Investigating Officer as and when directed by him.

(D) Applicants shall not influence witnesses or tamper with evidence.

Applications stand disposed of.
