Heard the learned counsel for the applicant and the learned APP.

Applicant is seeking pre-arrest bail in Crime No. 112 of 2018 registered with Igatpuri Police Station for offence punishable under Sections 143, 147, 148, 149, 307 of the Indian Penal Code. The submission of the learned counsel for the applicant is in

2 918.88.19 aba.doc absence of motive, intention and direct evidence connecting the applicant with an active role in the commission of crime in question, applicant cannot be arrested. According to the learned counsel uncomfortable caste equations are relied upon for registration of offence.

The learned APP based on investigation papers opposed the claim.

The victim in the present case has suffered grievous injury as is reflected in the medical papers. There are statements of the victim connecting the present applicant alongwith other co-accused to the crime in question.

As there is prima facie material available against the applicant, no case for grant of pre-arrest bail is made out. Application stands rejected.
