In crime No.92/2018 for offfence punishable under sections 302, 307, 120(B), 143, 147, 148, 149, 323, 504, 506 of the Indian Penal Code and under sections 4, 5, 25 and 27 of the Indian Arms Act registered with Sangli City police station, District Sangle, the applicant is arrested on May 1, 2017 and came to be charge-sheeted for the murder of one Ravindra. 3.

According to learned counsel for the applicant, except the complainant, no other witnesses have named the applicant.

Learned APP opposed the bail application.

Apart from the fact that the applicant was named with an active role in the commission of the offence by the complainant, there are other eye witnesses to the incident who have named the applicant in the crime in question with an active role. There is direct evidence on record to infer mens rea on the part of applicant in the offence punishable under section 302 of the Indian Penal Code.

That being so, the application fails and is rejected. (NITIN W. SAMBRE, J.)
