Since the Court was not inclined to grant relief claimed in this application, learned counsel for applicant, on instructions, sought permission to withdraw this application. It is, however, submitted that the applicant is presently residing at Uttar Pradesh and he would require some time to surrender. It is prayed that applicant be granted two weeks time to surrender before investigating officer. 2.

In view of these submissions, the application is allowed to be withdrawn and dismissed as such. The applicant is permitted to surrender before the investigating officer within a period of fifteen days from today. Pursuant to the arrest of applicant, in the event applicant prefers application for bail, the same shall be decided by the Court on merits and in accordance with law without being
