IN THE HIGH COURT OF JUDICATURE AT BOMBAY
CIVIL APPELLATE JURISDICTION CIVIL APPLICATION NO.92 OF 2018 IN WRIT PETITION NO.538 OF 2018 M/s. Yogi Housing Corporation & Anr.
.. Petitioners Vs.
State of Maharashtra & Anr.
.. Respondents Mr. Satyadev D. Joshi i/b. Devendra B. Singh for the applicant/petitioner. Mrs. Vaishali Nimbalkar, AGP, for respondent no.1. CORAM : A.K. MENON, J.
DATED : 19TH MARCH, 2018.
P.C. :
1. By this writ petition, the petitioner seeks to assail an order dated 6 th November, 2017 passed by the First Labour Court on Exhibit C-14 wherein the prayer reads as follows:- "That the order dated 9 th May, 2017 of closing the cross of the applicant be set aside and the Advocate for the opponent be allowed to proceed with further cross from the stage where the cross of the applicant was closed."
2. The impugned order while considering the application has made it clear that there is no order to close the cross examination of the opponent-applicant and therefore the question of setting aside the order dated 9 th May, 2017 does not arise. In my view, the order is self1/2
24.caw-92.18.doc explanatory. The cross examination contemplated therein was not closed as recorded by the Labour Court.
3. In the circumstances, there is no need to interfere with the writ jurisdiction of this Court. The writ petition therefore is disposed of with the aforesaid observations.
4. In view of the disposal of the writ petition, nothing survives in the civil application. Civil application is also disposed of. (A.K. MENON,J.) wadhwa 2/2
