Heard learned Counsel for the petitioners. It appears that the challenge raised in the present petitions to the orders passed by the Labour Court, Mahad, dated 23 September 2014 and the Industrial Court, Thane, dated 17 October 2015, is covered by the decision of the Co-ordinate Bench of this Court rendered in Writ Petition No.152 of 2016 decided on 21 March 2016 (Shraddha Sandeep Vengurlekar vs. Raigad Zilla Parishad and Ors). The petitioners in the present proceedings are similarly placed as in the case of the petitioners in the said proceedings, who could not succeed as their petition came to be dismissed by this Court. This position appears to be not disputed. 2.

Learned Counsel for the petitioners states that it is likely that the ------------------------- January 3, 2023

pvr 5wp2083-16 orders passed by this Court in Shraddha Sandeep Vengurlekar vs. Raigad Zilla Parishad and Ors. (supra) are assailed by the said petitioners before the Supreme Court.

Be that as it may, as the present proceedings are covered by the order dated 21 March 2016 in the case Shraddha Sandeep Vengurlekar vs. Raigad Zilla Parishad & Ors. (supra), in my opinion, these petitions are also required to be dismissed in terms of the said judgment and order passed by this Court. It is, however clarified that, in the event, if any proceedings pursued before the Supreme Court in the case Shraddha Sandeep Vengurlekar vs. Raigad Zilla Parishad & Ors. (supra) succeed, it would be permissible for the petitioners to revive these petitions, on permissible grounds as may be available to the petitioners in law.

With such liberty to the petitioners, the present petitions are dismissed in terms of the order dated 21 March 2016 passed by the coordinate Bench of this Court in Shraddha Sandeep Vengurlekar vs. Raigad Zilla Parishad & Ors.
