Heard learned counsel for the Applicants.

There is already an order passed by this Court on 13th January, 2017. Learned A.P.P. states that the Applicants have been called after year

2/2 903-appp.47.2019.doc 2016 at the most on 3 occasions for assisting the police. 3.

Learned Counsel for the Applicants is disputing this. We do not wish to go into this issue. We, direct the Investigating Officer not to summon the Applicants telephonically or orally. If there presence is required, an intimation in writing shall be sent to them. If the Applicants do not co-operate or avoid to co-operate, it will be open for the Investigating Officer to move an appropriate application before this Court. 4.

Learned Counsel for the Respondent No.2 submits that later on Respondent No.2 has received some papers from the office of DRI. Again we do not wish to comment on that issue. We grant liberty to the Respondent No.2 to move an appropriate application after serving an advance copy thereof, on the other side.
