This application has been sent by the Applicant from Jail praying for condonation of delay of about two years in filing Criminal Appeal (St.) No.62 of 2015. Since the Applicant has already filed Criminal Appeal No.1005 of 2014, which Appeal has been admitted by us, a notice was issued to the Superintendent, Central Prison, Kolhapur to keep the Applicant present in this Court. Accordingly, this Applicant has been brought from the Central Prison at Kolhapur. On being asked, the Applicant states that in the light of the fact that an Appeal filed by him 1/2 APPA-63-15-APEAL-ST.-62-15.doc

earlier has been admitted, the Applicant may be permitted to withdraw the Criminal Application No.63 of 2015 as well as Criminal Appeal (St.) No.62 of 2015.

Accordingly, the Criminal Application No.63 of 2015 is dismissed as withdrawn. Criminal Appeal (St.) No.62 of 2015 is also dismissed as withdrawn.
