Learned Counsel for the petitioner submits that 56 Sugar Factories which are in running condition are either privatized or sold. In some cases this process is going on. Leaned Counsel submits that this process is against the basic policy of the State, SARFAESI Act and Maharashtra Co-operative Societies Act. After creation of the third party interest by way of sale, the Managing Committees of the Purchaser of Sugar Factories are creating and mortgaging part of the property for raising loans. Learned Counsel has placed on record G.R. dated 14th November, 2018 issued by the Department of Co-operative, Textile and Marketing, Government of Maharashtra. 2.

Learned AGP at this stage submits that appropriate instructions would be taken.
