Not on board. Upon production taken on board. Heard the learned Counsel for the applicants and the learned APP for State. Perused the papers.

This is an application under Section 438 and 482 of the Code of Criminal Procedure, 1973. The applicants herein have received 1/3

notice from Kandivali Police Station, Mumbai dated 12/1/2015 pursuant to the communication from Khadan Police Station, District Akola, whereby the applicants have been directed to remain present before the Investigating Officer at Akola on 17/1/2015 in connection with Crime No. 5 of 2015 registered at Khadan Police Station for offence punisable under Section 498A, 323, 406, 504, 506 read with Section 34 of the Indian Penal Code. The applicants herein are seeking transit bail to enable them to appear before the concerned Investigating Officer as they apprehend arrest in Crime No. 5 of 2015. In view of this, the applicants deserve transit bail for a period of 3 weeks from today. The applicants deserve protection till 5/2/2015. They can approach appropriate court having jurisdiction within given time.

Hence, following order is passed.

ORDER

(i) The application is allowed.

(ii) In the event of arrest in Crime No. 5 of 2015, the applicants be enlarged on bail on furnishing P.R. Bond in the sum of Rs.15,000/- each and one or two sureties in the like amount. (iii) The applicants shall furnish cash bail in the eventuality of their arrest, since the applicants hail from Mumbai and not from Akola. (iv) This order shall remain in force till 5 p.m. of 5/2/2015. The application is disposed of accordingly.
