Learned Counsel Mrs. Qureshi present for the petitioner and the learned Counsel Mr. Marwadi present for the respondent. The petitioner is also present before the Court.

Both the parties submit that in view of out of court settlement arrived between the parties, the respondent has agreed to pay Rs.2,00,000/- to the petitioner. Accordingly, the learned Counsel representing the respondent has handed over to the petitioner a demand draft for Rs.2,00,000/-.

The learned Counsel for the petitioner, under instructions, submits that the petitioner does not want to proceed with the petition in view of the settlement arrived between the parties. The petitioner
