Learned Counsel for the Respondent-Bank makes a statement that for a period of three weeks the Respondent-Bank shall not take possession of Shop Nos.4 & 5.

In view of the aforesaid statement and since the proceedings are pending before the Recovery Officer/DRT, learned Counsel for the Petitioner seeks leave to withdraw the Petition.

The Petition is allowed to be withdrawn with liberty to prosecute the proceedings before the Recovery Officer/DRT.

4.

We made it clear that we have not gone into the merits of the case and it would be open for the Recovery Officer/ DRT to pass orders as it deems appropriate.
