C.:- 1) Mr. Yagnik, learned A.P.P. across the bar tendered an Affidavit of Shri Vijay Ganpatrao Kumbhar, Senior Police Inspector, attached to Sinhgad Road Police Station, Pune. The steps taken by the Investigating Agency in tracing out the corpus namely Ms.Kajal Bilkis Shaikh are in detail mentioned therein. It is stated that accused Ashish @ Vishwas Rajendra Taktode is arrested on 30th January 2024 in C.R No.488 of 2023. 2) In the said Affidavit, it is also stated that, after the corpus was traced out with accused person, she was thereafter produced before the Child Welfare Committee (for short "CWC"). That, under the directions of HEMANT CHANDERSEN SHIV CWC, the corpus has been sent to Mahila Sevagram Sanstha, Deccan, Pune for her safe custody. Kavita Prakash Chavan, Care Taker of CWC, Mahila Sevagram Sanstha, Deccan, Pune. 3) The corpus through learned A.P.P. in the Open Court submitted that, she does not wish to reside with the Petitioner i.e. her mother and she is readily willing to stay at said Mahila Sevagram Sanstha atleast till she attains majority.
4) In view of above, the present Petition for habeas corpus is worked out. Petition is accordingly disposed off. 5) Though we disposed off the Petition, the Petitioner being the mother of corpus namely Ms.Kajal Bilkis Shaikh, is at liberty to adopt appropriate remedies for her custody as may be permissible in law.
