This is a petition of the year 2001. When the same was called out on 02/12/2015, Mr. Nikhil N. Pawar, learned Counsel for petitioner, expressed inability to argue the matter as the case-papers were not available with him. Therefore, the order was made permitting him to take xerox copies of the case-papers on the said date itself. The matter was thereafter posted for 05/12/2015. The matter did not appear on the said date but has appeared today. 2.
Today neither the petitioner nor his Advocate are present. By the order impugned in this petition, the petitioner has been directed to pay maintenance to the respondent no.1. The Sessions URS
2 WP 1574-01.doc-201 Judge who has made the impugned order has correctly appreciated both the factual as well as legal position and awarded maintenance to the respondent no.1. There is neither any perversity nor error apparent on face of record in the impugned Judgment and Order. There is accordingly no case made out for interference with the impugned order. The petition is therefore dismissed. The petitioner shall pay costs of Rs.2,500/- (Rupees Two Thousand Five Hundred Only) to the respondent no.1.
