Learned Counsel appearing for the petitioner submits that application for discharge under Section 239 of the Cr. P.C. was filed by the petitioner bearing Case No. 23/PW/2010 before the Additional Chief Metropolitan Magistrate, 66th Court, Andheri, Mumbai on 23rd July, 2013. Learned Counsel submits that application is yet to be heard. Therefore, the petitioner decided to approach this Court by filing the present petition.

In case the said application is still pending, we direct the Additional Chief Metropolitan Magistrate Court to dispose of the said application on its own merits within three months from the date of receipt of order of this Court. Parties undertake to co-operate with the Court. 3.
