By the present application, the applicant/appellant seeks condonation of delay of 23 days in filing the second appeal. Heard the learned counsel for the applicant and perused the application.

37-CAS-304-2020.doc The applicant, has in paragraphs 3 to 8 of the application explained the delay, which has occasioned in filing the second appeal. Reading of the said paragraph reveals that the delay is bonafide and therefore the same deserves to be condoned. The application is allowed in terms of Prayer Clause (b). The appeal is directed to be registered.

As far as the application for amendment and the application for withdrawal of the amount deposited in this court is concerned, they shall be adjudicated upon on the next date of hearing.

At the request of the counsel for the respondent, renotify to 15th June 2022.
