The present application is filed for enlargement on bail in Criminal Appeal No.196 of 2019. Earlier application under section 389 of the Code of Criminal Procedure was rejected on 13th August 2019. Today, the ground for seeking bail is that the applicant has completed almost half of the sentence. However, section 436A of Cr.P.C. is not applicable to the cases of convicts and it contemplates only the cases of under-trial prisoners. The present appeal is filed in the year 2019. In view of this, the application being sans merit deserves to be rejected. However, the learned counsel for the applicant shall circulate the matter for expeditious hearing of the appeal. Hence, Interim application is disposed of accordingly.
