By this Application, the Applicant - Accused apprehending arrest in connection with investigation of Crime No.454/2021 registered with Police Station Wanawadi, Pune under Section 353, 504, 506 r/w. Section 34 of IPC, is seeking anticipatory bail. 2.

The prosecution case as disclosed from the complaint lodged by Sou. Sunita Jadhav who is working as a Senior Technician (Recovery Cell) with the State Electricity Board is that while the Complainant had gone to disconnect the electricity connection to the house of the Applicant on account of arrears of the electricity Mamta Kale page 1 of 3

charges, she was filthily abused by the Applicant. It appears that the Complainant disconnected the electricity connection to the house of the Applicant and after leaving the spot, realised that she had left her helmet at the house of the Applicant. It appears that the Complainant again returned to the house of the Applicant and asked the minor daughter of the Applicant to give the helmet. It is the allegation that it is the minor daughter who is Juvenile in conflict with law assaulted the Complainant with slaps. It thus, prima facie, appears that the allegation about the use of criminal force is not against the present Applicant.

Learned APP did not dispute that electricity connection has already been disconnected and looking to the nature of the allegations custodial interrogation of the Applicant is not necessary. Hence, the following orderORDER 1.

In the event of her arrest in connection with investigation of Crime No.454/2021 registered with Police Station Wanawadi, Pune, the Applicant be released on bail on executing a P.R. Bond in the sum of Rs.25,000/- with one or two solvent sureties in the like amount.

The Applicant shall attend the Investigating Officer on 24/1/2022 between 11.00 a.m. to 1.00 p.m. and as and when directed by the Investigating Officer. 3.

The Applicant shall co-operate with the Investigating Agency and shall not tamper with the prosecution witnesses or evidence.

The Criminal Application is disposed of, in the aforesaid terms.
