Heard the learned Counsel for the applicant and the respondents.

A delay of 1 year and 62 days has occurred in preferring the appeal, mainly on the ground that the applicant was advised periodical surgeries and operations due to the accident and, therefore, he has been suffering from mental imbalance. Apart from that, he had to manage his day-to-day affairs and, therefore, he could not approach his advocate and give instructions to prefer an appeal in time. It is also stated that the applicant is a resident of village Khanapur, which is 75 by UDAY SHIVAJI JAGTAP Date:

Having considered the grounds raised in the application, though it is opposed by the Counsel for the respondent, it is a fit case where the delay needs to be condoned and stands condoned accordingly.
