Learned counsel for the Petitioner seeks leave to withdraw the writ petition with liberty to apply to Magistrate under section 173(8) of the Code of Criminal Procedure, 1973. Leave with liberty as prayed for is granted. Petition is allowed to be withdrawn and is disposed of as such.

It is needless to mention that in the event any order is passed by the Magistrate under section 173(8), the Petitioner is at liberty to approach this Court.
