P.C.:- 1) Applicant, partner in the firm namely "Khan Traders" has filed present Application to implead himself in place of Respondent No.2 to prosecute the Application.

2) Mr. Borulkar, learned Advocate for the Applicant submitted that, the Applicant and Original Respondent No.2 Muhammad Hussain Baiju Khan were partners in "Khan Traders". However during the pendency of present Application, the original Respondent No.2 passed away. Therefore he has filed present Application in his capacity as partner of the 1/2

3) Mr. Sawant, learned counsel for the Original Applicants has no serious objection in allowing present Application. 4) In view thereof and for the reasons stated in the Application, Application is allowed in terms of prayer clause (a). 5) Necessary amendment in the Criminal Application (APL) No.357 of 2016 be carried out within a period of three weeks from today.
