Applicant is seeking regular bail in Crime No. 76/2017 registered with Lonavala Rural Police Station, Dist. Pune for offence punishable under Sections 363, 376(2), 366 of the Indian Penal Code and Sections 4 & 6 of the Protection of Children from Sexual
2 904.111.19 ba.doc Offences Act (POCSO Act) 2012 The ossification test carried out on the victim depicts her age in between 16-18 years. The statement recorded under sections 161 & 164 of Code of Criminal Procedure, 1973 requires compliance of necessary ingredients of POCSO Act.
In the aforesaid background, even if the case of the applicant of love affair is accepted, still the fact remains that the provisions of POCSO Act in the wake of medical report are rightly invoked. That being so, no case for bail is made out. Application stands rejected. [NITIN W. SAMBRE, J.]
