The learned counsel for the petitioner seeks permission to withdraw this petition with liberty to challenge the order made by the Additional Divisional Commissioner, Pune on the application made under sub-section (1) of section 48 of the Land Acquisition Act,1894.

The application made before the Hon'ble Minister (Exh.B to the petition) is not maintainable as the Divisional Commissioner has already rejected the application under subsection (1) of section 48 of the said said Act.

Accordingly, the writ petition is disposed of as withdrawn
