The above Writ Petition was dismissed for default by an order dated 7 th June, 2010. The issue involved in the above Writ Petition is referred to the Larger Bench by an order of this Court dated 19 th July, 2005/12 th September, 2005. I am informed that in the last seven years, the Larger Bench is not constituted to decide the said issue. In view thereof, no prejudice will be caused to the Respondent if the above order dated 7 th June, 2010 is set aside and the Writ Petition be taken up for hearing after the Larger Bench is constituted and the issues decided by the Larger Bench. The order of dismissal dated 7 th June, 2010 is accordingly set aside and the above Writ Petition is restored to file. The above Civil Application is accordingly disposed off. ( S.J.KATHAWALLA, J. )
