The applicants who are apprehending their arrest in Crime No. 593 of 2022 registered at Baramati Police Station, Pune for the offences punishable under Sections 498A, 377, 323, 504, 506 r/w. 34 of Indian Penal Code have filed these applications under Section 438 of the Code of Criminal Procedure, 1973 for anticipatory bail. 1 / 3

I have heard the learned Counsel for the applicants, the learned APP for the State and the learned Counsel for respondent No.2. 3.
The complainant was married to the applicant in Anticipatory Bail Application No.94 of 2023 on 27 November 2020. The applicant Nos.1 and 2 in Anticipatory Bail Application No.95 of 2023 are father-inlaw and mother-in-law of the complainant and applicant Nos.3 to 5 in the said application are their family friends.

According to the prosecution, after marriage when the complainant came to cohabit with the applicants, they told her to bring Rs.25 lakhs from her parents to purchase flat and as the complainant was not able to fulfill their demand, she was subjected to all sorts of illtreatment. There are allegations of unnatural sex against the husband. 5.
There appears to be delay in lodging the F.I.R. There is no need of custodial interrogation. Considering the overall facts and circumstances of the case, I am inclined to grant anticipatory bail to the present applicants. In the result, the following order is passed : (i) Application is allowed.
(ii) In the event of arrest of the applicants in Crime No. 593 of 2022 registered at Baramati Police Station, Pune for the offences punishable under Sections 498A, 377, 323, 504, 506 r/w. 34 of Indian Penal Code, they shall be released on furnishing P.R. Bond in the sum of Rs.25,000/- each with one or more sureties in the like amount. 2 / 3
(iii) The applicants shall attend the concerned police station as and when called by the Investigating Officer and shall co-operate in the investigation.
