The learned Advocate appearing for the Respondent has tendered a copy of the unsigned Consent Terms and a copy of the letter dated 3 rd March, 2017 addressed by the Advocate for the Respondent to the Applicant, which letter is counter signed by the Respondent. The Advocate for the Respondent states that he has prepared the Consent Terms on the basis of the contents of the said letter. He submits that the Respondent is at present out of the country since he is employed as a Merchant Engineer with the Merchant Navy. He states that the Respondent undertakes to sign the Consent Terms and obtain divorce by mutual consent before the learned Civil Judge, Senior Division, Thane in September-2017. The statements and undertakings are accepted and the copies of the Consent Terms as well as the letter dated 3 rd March,

In view of the above statements / undertakings, the Applicant seeks to withdraw the above Application. The Application is disposed off as withdrawn. However, the Applicant is granted liberty to approach this Court in the event of the Respondent not complying with the statements / undertakings recorded as above. ( S.J.KATHAWALLA, J. )
