IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CIVIL APPELLATE JURISDICTION APPEAL FROM ORDER (ST) NO. 1153 OF 2016 Jagjeet Singh Vijan ... Appellant Vs.

The Assistant Commissioner M/West Ward ... Respondent Mr. S.S. Kudalkar i/b. CORPS Legal, Advocate for the Appellant. CORAM: MRS.MRIDULA BHATKAR, J.

DATE: 15th JANUARY, 2016 P.C.:

Not on board. Upon mentioning, taken on board. 2.

This Appeal from Order is preferred against the order dated 11th January, 2016 wherein the learned Judge of the trial Court has refused to continue the ad-interim relief.

3.

The learned counsel for the appellant submitted that he is ready to go head with the matter before the trial Court. 4.

I have perused the order passed in roznama. It discloses that the learned Judge is ready to take up the matter if such request comes from the plaintiff, i.e., appellant. The ad-interim injunction granted earlier was discontinued only on the ground that the learned counsel for the plaintiff was not ready to go head with the matter. In view of this, no relief is 1 / 2

Prod8.AOSt1153_2016.doc required to be granted in this matter. Parties to appear before the trial Court on 20th January, 2016 and the trial Court may proceed with the matter at the earliest and dispose of Notice of Motion. 5.

Appeal from Order is disposed of.
