1. The office remark shows that the second Respondent (Original Accused) has died on 23rd January 2013. A copy of the death certificate issued by the Mumbai Municipal Corporation is placed on record alongwith the report dated 13th June 2016 submitted by Senior Inspector of Police of Lokmanya Tilak Marg Police Station,Mumbai.

By the impugned order, the second Respondent accused has been acquitted of the offence punishable under Section 406 of the Indian Penal Code. In view of the death of the Second Respondent, this Appeal does not survive as it stands abated, and the same is disposed of as such.

3. The Criminal Application No.3693 of 2000 does not survive and the same is disposed of.
