Learned advocate appearing on behalf of respondent No.2 states that the complaint is fixed for conducting cross-examination of the complainant. The challenge in this petition is to the order of issuance of process in a proceedings under section 138 of the Negotiable Instruments Act, 1881. Since the hearing is started there is no reason to interfere with the order. 2.

The writ petition stands disposed of keeping open all contentions raised by the petitioner to be raised before the Magistrate at appropriate stage.
