P.C.:- By an Order dated 13th January, 2017, the Applicants were granted interim relief and were directed to attend the Investigating Agency on stipulated dates, to join the process of investigation. The record indicates that, the son of the Applicant No.1 and brother of Applicant No.2 namely Shri. Vaibhav Shamrao Kuveskar is the prime accused in the present crime and as per the prosecution, he was instrumental in preparing the alleged bogus documents claiming occupancy/tenancy in the SRA Scheme for getting a residential premises.
It is the further prosecution case that, said Shri. Vaibhav 1/2
ssm 2 1-aba68.17.doc Kuveskar created those documents under the instructions of Applicant No.1. The record indicates that, the said Shri. Vaibhav Kuveskar was arrested by police and now has been released on regular bail. That, the investigation has already been completed and the police have submitted charge-sheet.
Taking into consideration the allegations against the Applicants and the fact that they are women, this Court is of the opinion that, their custodial interrogation for further investigation of the present crime is not necessary and they can be released on prearrest bail. Interim relief dated 13th January, 2017 is hereby confirmed. However, the condition to attend the Investigating Officer of the concerned Police Station is waived.
