Applicant is Advocate Notary of 64 years of age, practising at Pune. The allegation against him is that, in absence of one Sagar Suryawanshi, he has notarised his Affidavit.

Besides, this allegation, no other allegation has been brought to my notice which would constitute

Rane 2/3 ABA 134-2020 (SR. 918) the offence much less cognisable. Even prosecution has not disputed this position. In view of the nature of accusations, age of the applicant and his profession, there is no possibility of his non-availability for further investigation. Learned APP, on instructions, submitted that the applicant had reported to the Investigating Officer as and when called and his statements were recorded. That as such, his custodial interrogation is not required. In view of the facts of the case and nature of accusations, in the event of arrest of the applicant in Crime No.I-165/2019 registered with Shivaji Nagar Police Station, Pune he shall be released on bail on furnishing P.R. Bond of Rs.20,000/- (Rs. Twenty Thousand only), with one or two sureties in the like sum.

The applicant shall attend the concerned Police Station as and when called.

The applicant shall furnish the particulars of his place of residence and contact details to the Investigating Officer of the

Rane 3/3 ABA 134-2020 (SR. 918) Police Station concerned within seven days from today;

The applicant shall not tamper with the evidence or attempt to influence or contact the complainant, witnesses or any person concerned with the case.

It is made clear that observations made hereinabove shall be construed as expression of opinion only for the purpose of granting bail and the same shall not in any way influence the trial in other proceedings.

Application is disposed off.
