Heard learned counsel for the applicant.

This is an application for bail through jail. The applicant is in custody since 12/08/2016 almost for a period of 6 years and 6 months for the alleged offence punishable under Section 302 of the Indian Penal Code, 1860. On record is the statement of his two children who are eye witnesses to the incident.

Learned APP submitted that the trial has already commenced and three witnesses has been examined. It is 1/2

9. ba 126.23.doc however pointed out by the learned counsel for the applicant that since the year 2020 there is no substantial progress in the trial.

I am not inclined to release the applicant on bail considering the nature of the accusations and having regard to the fact that the trial has commenced. The trial Court is requested to expedite the trial.

The application is disposed of.

6.

Liberty to the applicant to file a fresh application for bail after six months if the trial does not progress substantially.
