By an order dated 17.1.2017, a statement made by the learned counsel for the petitioner was recorded to the effect that the petitioner would pay the balance amount of Rs.2,37,500/- to respondent No.2 within a period of four weeks from 17.1.2017. The Hon'ble Court had accepted the said statement.

The learned counsel for respondent No.2 submits that the order had not been complied with. The note put up by the Office shows that the Petition to be placed under the caption of "dismissal" (as per the Court's order dated 17.1.2017.

The Petition stands dismissed for want of prosecution. 5.

Needless to say that the judgment and order dated 2.5.2013 passed by the Metropolitan Magistrate, 50th court, Vikhroli, Mumbai and the judgment and order dated 6.1.2015 passed by the Sessions Court shall take its own course and effect forthwith.
