Heard the learned counsel for the parties. Perused the contents of the application. Also perused the order dated 29th November, 2013.
It appears, after hearing the parties for some time, that this Court had declined interim relief in favour of the petitioner as the petitioner had approached the Court on the verge of retirement.
bsb 2 CAW213.15.doc This Court, therefore, did not permit the petitioner to continue in service. By this civil application, the petitioner has sought a direction to the management to send the proposal of the petitioner to the University and a direction to the University to constitute a Performance Review Committee for considering the case of the petitioner. In the facts of the case, we decline to grant the prayer made in the civil application, especially when it is pointed out to this Court by the learned counsel for the management that, initially, the petitioner was not inclined to seek the extension of the age of retirement and had sought for the retirement benefits. The prayer made in the civil application stands rejected. The civil application stands disposed of accordingly. (C. V. BHADANG, J.) (VASANTI A. NAIK, J.)
