This Civil Application is taken out for condonation of delay in filing the Second Appeal, which arises out of a suit for partition. The record shows that by the order dtd.1st April, 2014 passed by the Registrar (Judicial), High Court, Bombay, the application was recorded as having been abated against respondents no. 2 and 3. Considering

Dusane 2/2 CAS157.2013 the nature of the suit, on abatement of the application in respect of respondents no.2 and 3, it stands abated in it's entirety. Hence, removed from the board.

In view of disposal of the above Civil Application, the Civil Application No.158 of 2013 does not survive, the same is accordingly disposed off.
