Learned counsel appearing for the respondent made a statement before this court on 18th October,2016 that the Marriage Petition No.81 of 2012 is at the stage of the cross examination of the witnesses. The statement made by the learned counsel for the respondent was disputed by the learned counsel for the applicant. This court accordingly directed the respondent to file an affidavit and to enclose the latest Roznama of the proceedings filed by the respondent against the applicant in the Court of Civil Judge, Senior Division, Kalyan within one week from the date of the said order.

Learned counsel for the respondent invited my attention to the Roznama in the Marriage Petition No.81 of 2012 to that indicate that on 7th June 2016, the evidence of the respondent herein is closed. It further indicates that on 17th September 2016, the evidence of the applicant herein is directed to be commenced. In these circumstances, I am not inclined to entertain this misc.civil application filed by the applicant.

The applicant is directed to proceed with the pending trial before the Family Court expeditiously.
