This petition is filed with the following prayer: "By suitable writ, order or direction this Hon'ble Court be pleased to direct the Respondents to forthwith take final decision on the applications submitted by the Petitioner for changing his date of birth and accordingly, forthwith remove presently recorded birth date as 1-6-1963 and record correct birth date of the Petitioner in his service Book as 17-3-1968 as recorded in birth certificate issued under Sections 12/17 of the Births & Deaths Registration Act, 1969."

Learned Counsel for the Petitioner informs that as per the procedure it is the school management which has to forward the

rsk 2/2 38-WP-2628-20.doc proposal to the Education Officer who in turn forwards it to the Deputy Director of Education.

The Learned Counsel appearing for the Respondent/Management states that on 28/1/2021 proposal of the Petitioner is submitted to the Education Officer to be forwarded to the Deputy Director of Kolhapur.

In the light of this subsequent development, we dispose of this petition directing the Education Officer, Zilla Parishad, Kolhapur to forward the proposal to the Deputy Director of Education within a period of 2 weeks, if not already forwarded. After the receipt of the said proposal, the Deputy Director of Education will decide the same within a period of 6 weeks and communicate the decision to the Petitioner. If not received then within 6 weeks from the date the Deputy Director received the proposal from the Education Officer. 5.

The Petition is accordingly disposed of.
