Mr.Shah, Learned counsel appearing for the Petitioners on instructions states that the Solapur Municipal Corporation did not act upon the impugned notice. He therefore seeks leave to withdraw the Petition with liberty to file a fresh petition in the event a fresh tender notice is issued by the Municipal Corporation. Accordingly, we dispose of the Petition as withdrawn with liberty as prayed for. All contentions of the parties on merits are kept open.
