This is an application for anticipatory bail filed by the aforesaid applicant apprehending his arrest in complaint lodged by Savitri Kotgonde pursuant to which the learned JMFC, Mangalwedha has by order dated 18th December, 2015 under Section 156(3) of the Cr.P.C. in Cri. M.A. No.394 of 2015, directed registration of crime. 2.
The applicant herein had filed an application for anticipatory bail and had also sought interim bail. The interim bail sought by the present applicant has been rejected on 6th January, 2016 by the learned Addl. Sessions Judge, Pandharpur. 3.
The learned Addl. Sessions Judge, Pandharpur has rejected
the interim bail on the ground that there are allegations that the applicant herein had committed rape on the victim under the promise of marriage. It is pertinent to state that the anticipatory bail application is fixed for say on 20th January, 2016. If the applicant is not protected by interim bail, the application for interim bail pending before the Addl. Sessions Judge, Pandharpur will be rendered infructuous. Hence in my considered view, this is a fit case to grant interim bail with further direction to the Addl. Sessions Judge, Pandharpur to dispose of anticipatory bail application as expeditiously as possible, in any event on or before 31st January, 2016. 4.
In the above circumstances, the application is allowed on the following terms and conditions.
1. In the event of arrest of the applicant in crime registered pursuant to the order under Section 156(3) of the Cr.P.C. by the learned JMFC, Pandharpur in Criminal M.A. No.394 of 2015, the applicant shall be released on bail released on bail bond of Rs.20,000/- (Rupees Twenty Thousand Only) with one or two sureties in the like amount to the satisfaction of the Addl. Sessions Judge, Pandharpur.
2. The applicant shall report to investigating officer on every Monday, Wednesday and Friday from 10 am to 2 pm from the receipt of this order and further as and when required by the investigating officer for the purpose of the interrogation till disposal of the application.
3. The applicant shall not tamper with the evidence or influence complainant and witnesses in any manner.
4. This order shall remain in force till 30th January, 2016.
5. The application stands disposed of accordingly. ( ANUJA PRABHUDESSAI, J. )
