3. By this First Appeal, the Appellant is challenging the Judgment and award dated 28/07/2010 passed by the Motor Accident Claims Tribunal, Alibag, Raigad in Motor Accident Claim Petition No. 182/2008.

4. The Learned Counsel for the Appellant submits that, matter is settled between the parties. She submits that, she has received instructions from her client to withdraw the First Appeal unconditionally. To that effect Laxmi 1/2

5. Hence, the following order:

[ a. First Appeal as well as pending Civil Application stand disposed of as withdrawn unconditionally.

b. Registry is directed to transfer a sum of Rs. 25,000/- deposited by the AppellantInsurance Company at the time of filing the First Appeal to the Motor Accident Claims Tribunal, Raigad in the account of Motor Accident Claim Petition No. 182/2008.

c. Refund Court fees as per rule.
