This is an application filed under Section 438 of the Code of Criminal Procedure, 1973 for anticipatory bail. 2.

The applicant is apprehending his arrest in Crime No. 1176 of 2022 registered at Yawat Police Station, Pune for the offences punishable under Sections 354-D, 341 of Indian Penal Code and Sections 8, 12 of the Protection of Children from the Sexual Offences Act, 2012. 3.

I have heard the learned Counsel for the applicant, the learned APP for the State and the learned Counsel for Respondent No.2. 4.

According to the prosecution, the present applicant used to stalk the victim. It is alleged that on 24 December 2022, the present applicant accosted the victim, while she was returning home from the school, and proposed her to have love relationship with him. Kanchan P Dhuri 1 / 2

The learned Counsel for the applicant submits that the applicant is a student. It is submitted that there is no need of custodial interrogation.

Considering the facts and circumstances of the case and as there are no other criminal antecedents, I am inclined to grant anticipatory bail to the present applicant on certain conditions. In the result, the following order is passed :

(i) Application is allowed.

(ii) In the event of arrest of the applicant - Bhimrao @ Yuva Suresh Bhandari in Crime No. 1176 of 2022 registered at Yawat Police Station, Pune for the offences punishable under Sections 354-D, 341 of Indian Penal Code and Sections 8, 12 of the Protection of Children from the Sexual Offences Act, 2012, he shall be released on bail on furnishing P.R. Bond in the sum of Rs.25,000/- with one or more sureties in the like amount.

(iii) The applicant shall not enter into the limits of Village : Deolgaonwada.

(iv) The applicant shall not contact the victim, either directly or indirectly.

(v) The prosecution/complainant is at liberty to file an application for cancellation of bail, if the conditions are breached. ( N.R. BORKAR, J. ) by KANCHAN PRASHANT DHURI Date:
