In view of averments made in paragraphs- 2 and 3 of the application, a case for restoration is made out. Accordingly, application is allowed in terms of prayer clause (a).

Restored writ petition shall be placed high upon board on 7th February 2018. In the meanwhile, learned counsel appearing for the Municipal Corporation shall take instructions and make statement as to what action the Corporation desires to take on the basis of the application of the petitioner.
