At the outset, learned APP on the instructions of the investigating officer, Mr. Raskar, PSI, who is present in Court submits that the trial has commenced and that five witnesses have been examined till date. She submits that the prosecution intends to examine four more witnesses.

Considering the fact that the trial has commenced, it is not necessary to consider this Application for bail at this stage. Since the trial has commenced and the Applicant is in custody for

BA 121-19.doc the last three years, the trial of the Applicant is expedited. The learned Sessions Judge to conclude the case as expeditiously as possible and in any event within four months from the date of receipt of this order.

Accordingly, the Application is disposed of.
