The petitioners challenge the order passed by the City Civil Court, Mumbai on 6 September, 2014 to the extend it holds that petitioners are gratuitous licensee. It is not possible to entertain writ petition against the findings. If the petitioners are aggrieved by the order of return of plaint on incorrect observations, then it is open to the petitioners to file an appeal from an order which is provided under Order 43 of the Code.

In view of this position, no interference is warranted. The Writ Petition is rejected.
