This is an application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of bail.

The applicant came to be arrested in Crime No. 332 of 2019 registered at Dattawadi Police Station, Pune for the offence punishable under Sections 306, 498-A, 323, 504 of Indian Penal Code. 3.

I have heard the learned Counsel for the applicant and the learned APP for the State.

The deceased was the wife of the present applicant. It is alleged that the present applicant was addicted to liquor. He used to beat the deceased by suspecting her character. It is alleged that the deceased Kanchan P Dhuri 1 / 2

6-BA-232-2021.odt thus got fed up with the harassment and committed suicide on 17 January 2020.

Considering the fact that the applicant is in jail for more than three years, I am inclined to release him on bail. Hence, the following order is passed :

(i) Application is allowed.

(ii) The applicant - Avinash Nandu Bhosale be released on bail in Crime No. 332 of 2019 registered at Dattawadi Police Station, Pune for the offence punishable under Sections 306, 498-A, 323, 504 of Indian Penal Code on furnishing P.R. Bond in the sum of Rs.25,000/- with one or two sureties in the like amount.
