IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CRIMINAL APPELLATE JURISDICTION ANTICIPATORY BAIL APPLICATION NO.113 OF 2019 Haresh Ravindra Zope ..Applicant.

V/s.

The State of Maharashtra ..Respondent.

Mr.Vishal L.Kolekar for the applicant.

Mrs.Rutuja Ambekar, APP for the respondent-State. CORAM : NITIN W. SAMBRE, J.

DATE : JANUARY 15, 2019 P.C.:- Heard learned counsel for the applicant and learned APP for the State.

2.

In crime No.689/2018 for offfence punishable under sections 420, 467, 468 read with 34 of the Indian Penal Code registered with Talegaon Dabhade police station, Taluka Maval, District Pune, the applicant is seeking pre-arrest bail. 3.

It is the case of the applicant that in the transfer of the land of the complainant, he has never received any consideration nor beneficiary from the same.

2 912) aba113-19.doc 4.

According to him, the main accused, who has received the amount of consideration is already released on regular bail. In absence of any antecedents, the applicant is entitled to be released on pre-arrest bail.

5.

Considered the response of the learned APP to the claim of the applicant.

6.

The fact remains that the applicant has received an amount of Rs.20 lakhs from the co-accused. Though, learned counsel for the applicant has tried to explain the same as an outcome of a different transaction between him and the main accused, there is hardly any material to infer the same from record.

7.

The fact that the applicant is a beneficiary in the crime in question, having received an amount of Rs.20 lakhs, is sufficient enough to connect him in the crime in question. As such, there is no substance in the application.

8.

The application is rejected.
