By this petition, the petitioner has challenged an order rejecting an application seeking disposal of the Complaint (ULP) No.233 of 2012 in view of a settlement said to have been arrived at. However, in view of the order passed today in Writ Petition No.2694 of 2013, the challenge in this petition will not survive since now only the main complaint will have to be disposed. 2.

Mr.Bapat, learned counsel on instructions of Mr.Nischad Salan, Associate Head (IR) prays for withdrawal of the petition. In the circumstances, the following order is passed : (i) Petition is allowed to be withdrawn.

(ii) In view of disposal of this petition, the Industrial Court shall also decide the issue as to whether or not there was a settlement. The main Complaint 1/2
