This is an application seeking relaxation of condition (iii) in the order of bail passed by this Court on 21st September 2018 (Coram: Prakash D. Naik, J) in Criminal Bail Application No. 1809 of 2018, which reads thus :- "(iii)The applicant shall report Kandivali Police Station once in a month on every first Monday between 10 am and 12 noon till further orders;"

Learned Counsel for the applicant submits that ever since his release on the aforesaid date, the applicant has been attending the concerned police station which is evident from the report submitted by the learned APP today, forwarded by the Senior Police Inspector of Kandivali Police Station. It is submitted that the trial has not yet commenced. The bail order also reveals that the relationship between the applicant and the victim was consensual. 3.

Having considered the aforesaid facts, even though Mr. Satpute, learned APP opposes the application, I am inclined to relax the said condition.

As such, condition (iii) is relaxed. However, rest of the conditions will remain as it is.
