At the outset, learned counsel for the applicant seeks leave to withdraw the application with liberty to file a fresh application before the Special Court. He submits that the DNA report was not on record when the applicant's first bail application was rejected by the Sessions Court as well as the High Court. Learned A.P.P does not dispute the said fact.

Considering the aforesaid, the application is disposed of as withdrawn with liberty as prayed.
