The applicant is arrested on 20th December 2020 in connection with CR No.255 of 2019 registered with MHB Colony Police Station for offences under Sections 420, 465, 467, 471, 472, 34 r/w Section 120B of Indian Penal Code.

The complainant is related to the husband of applicant. It was alleged that on 28th March 2018 the applicant and her husband had prepared false documents to represent that they are owners of flat premises and that the flat was mortgaged.

The complainant is present in the Court. She is identified by learned advocate representing her. He undertakes to file Vakalatnama. It is pointed out that the complainant had filed purshis before Sessions Court stating that she has no objection for granting bail to the applicant.

The applicant is lady. Her husband suffered heart attack on 17th December 2020 and he was declared dead in hospital. Immediately thereafter she was arrested and is in custody. Learned counsel for complainant, on instructions from complainant, who is present in Court, submits that she has no objection in granting bail to the applicant. The applicant is in custody from the date of arrest. Considering the aforesaid circumstances, further detention of the applicant is not necessary. Hence, I pass following order :

ORDER

(i) Bail Application is allowed and disposed of;

(ii) The applicant is directed to be released on bail in connection with CR No.255 of 2019 registered with MHB Colony Police Station on executing PR bond in the sum of Rs.20,000/- with one or more sureties in the like amount;

(iii) The applicant is permitted to furnish provisional cash bail security in the sum of Rs.20,000/- in lieu of surety for eight weeks; (iv) The applicant shall attend MHB Colony Police Station as and when called for till filing of charge sheet.
